By accessing and using upLicence ("the Platform"), you accept and agree to be bound by these Terms of Use. If you do not agree to these terms, you must not use our services.
2. Description of Service
upLicence is an online platform that connects learner drivers with qualified driving instructors. We facilitate bookings and payments but are not a party to the actual driving lesson agreement between students and instructors.
3. User Accounts
To use certain features of our Platform, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and update your information to keep it accurate
- Maintain the security of your account credentials
- Accept responsibility for all activities under your account
4. Bookings and Payments
4.1 Booking Process
When you book a lesson through our Platform, you enter into a direct agreement with the instructor. upLicence acts as a facilitator and is not responsible for the quality of instruction or any issues arising from the lesson.
4.2 Payment
Payment is processed securely through our payment partners. All prices are displayed in Australian dollars and include GST where applicable.
4.3 Cancellations and Refunds
Cancellation and refund policies are set by individual instructors and displayed on their profiles. upLicence's refund policy applies only to platform fees, not lesson fees.
5. User Conduct
You agree not to:
- Use the Platform for any illegal or unauthorized purpose
- Violate any laws in your jurisdiction
- Infringe on the rights of others
- Transmit any viruses or malicious code
- Attempt to gain unauthorized access to the Platform
- Interfere with or disrupt the Platform or servers
- Post false, misleading, or defamatory content
6. Reviews and Content
You may submit reviews and other content. By submitting content, you grant us a non-exclusive, royalty-free license to use, modify, and display such content on our Platform. You represent that you have the right to grant this license.
7. Intellectual Property
The Platform and its content, including but not limited to text, graphics, logos, and software, are the property of upLicence or its licensors and are protected by copyright and other intellectual property laws.
8. Limitation of Liability
To the maximum extent permitted by law, upLicence shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Platform.
9. Indemnification
You agree to indemnify and hold harmless upLicence, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of the Platform or violation of these Terms.
10. Termination
We may terminate or suspend your account and access to the Platform immediately, without prior notice, for any reason, including breach of these Terms.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Platform and updating the "Last updated" date.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Victoria, Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria.
